We created this Privacy Policy to disclose how we gather, store, use and protect the information we collect on our website www.digiteum.com. Please, read this document carefully and do not access our website if you don't agree with what is written below.

The owner of the website www.digiteum.com (“Digiteum website”) and the controller of the data of persons using the Digiteum Website is Digiteum Sp. z o.o. with its registered office in Gdańsk, Poland, address: Szafarnia 11/F8, 80-755 Gdańsk, entered into the Register of Entrepreneurs kept by the District Court of Gdańsk-Północ in Gdańsk, VII Commercial Division of the National Court Register under KRS number: 0000866372, NIP: (tax ID): 5833409796, with the share capital of PLN 10 000.

Digiteum website usage

No user of Digiteum website may distribute, exchange, modify, sell, or transmit any information published on this site, including but not limited to any text, images, audio or video, for any business or commercial purpose without our written expressed permission. We gather, use, store, and secure your personal data according to the provisions of the General Data Protection Regulation on data protection and privacy in the European Union and the European Economic Area adopted on 14 April 2016 and in force as of 25 May 2018 (“GDPR”).

We do not sell, share or rent any information you provide on our website. We store the data of our clients and leads using secure CRM platforms that comply with GDPR and take all necessary precautions to make sure your information is safe. Access to your information is restricted to the authorized personnel at Digiteum.

V. COLLECTION OF PERSONAL DATA

Digiteum collects and process your personal data in the following fields:

1. USING OF THE WEBSITE

1.1. When you are using the Digiteum website, our servers may collect information about your activity on our website using cookies. This information includes but is not limited to your IP address, browser type, ISP, referring/exit pages, date/time stamp, number of clicks, domain name and country/state, and location information.
1.2. Digiteum processes the personal data of users of the Digiteum website:
1.2.1. for providing to the Digiteum website – the legal basis of the processing is the legitimate interest of the Controller (Article 6 item 1 letter f of the GDPR), involving the provision of information about the Controller's services and products;
1.2.2. for analytical, statistical and marketing purposes - the legal basis of processing is your consent (Article 6 item 1 letter a of the GDPR).

2. CONTACT FORM

2.1. The contact form allows you to send inquiries about our services. To answer your inquiry, we collect the following data: i) name, ii) business e-mail address, iii) company name, vi) additional message.
2.2. This data is used to answer your inquiry, provide you with our services - the legal basis for the processing is the Controller's legitimate interest in marketing of own services (Article 6 item 1 letter f of the GDPR) in connection with your consent given by the Act on Provision of Electronic Services and the Telecommunications Law.

3. RECRUITMENT

3.1. You can apply for the current job offer (recruitment processes) of your choice by providing your i) first name, ii) last name, iii) mobile, iv) email, v) country vi) city, vii) recruitment details. You can also attach an external document containing your resume and portfolio.
3.2. The data you provide will be processed by us:
3.2.1. if you prefer employment based on an employment contract your data will be processed based on Article 6 item 1 letters b. and c. of the GDPR, i.e., to perform obligations arising from legal provisions related to the recruitment process, including in particular Article 22(1) of the Labour Code and to take steps at the request of the data subject before agreeing with Digiteum. To carry out the recruitment process in the field of data not required – the legal basis for processing is consent (Article 6 item 1 letter an of the GDPR);
3.2.2. if you prefer employment based upon a civil law contract your data will be processed on the legal basis of Article 6 item 1 letter b. of the GDPR, i.e., to take steps at the data subject's request before agreeing with Digiteum. To carry out the recruitment process in the field of data not required – the legal basis for processing is consent (Article 6 item 1 letter a. of the GDPR);
3.2.3. if you have agreed to participate in future recruitments, the basis for processing your personal data after recruitment will be Article 6, item 1 letter a of the GDPR, i.e., your consent to processing your personal data to consider your candidacy in future recruitments.
3.3. Your personal data can be process by us for the purpose of possibly establishing, investigating or defending against claims - the legal basis for our processing is the legitimate interest (Article 6 item 1 letter f of the GDPR) consisting in the protection of our right.

4. INTERACTING WITH US THROUGH SOCIAL NETWORK PROFILES

4.1. You can interact with us through our social media. In this case we process your publicly available personal data on the service, such as name, surname, image and, in the case of sending messages, data provided voluntarily in the content of the message.
4.2. Your personal data will be processed for the purpose of administering ours profile on social networks, by responding to messages, comments and reactions, as well as for statistical and advertising purposes carried out through the tools provided within these social networks, on the basis of our legitimate interest (Article 6 item 1 letter f of the GDPR), which is business communication with users of social networks, marketing the ours services and products by providing informational content about us, its services and products, and building the our brand. If you send to us more information than indicated in item 1, the basis of processing this information will be your consent (article 6 item 1 letter a of the GDPR).

VI. IS IT NECESSARY TO PROVIDE DATA?

Providing data:
1. to contact with us by form or through the social media is always voluntary, but necessary for the purposes of communication with you. If you do not provide the required data, we will not be able to contact with you.
2. to download free materials is always voluntary, but necessary to send you materials. If you do not provide the required data, we will not be able to deliver the download.
3. marked as required for recruitment is a contractual condition, and if you prefer employment based upon employment contract is also required by law, in particular the Polish Labour Code. The consequence of not providing your data marked as obligatory is that your application cannot be considered in the recruitment process. As far as other data is concerned, the provision of such data is voluntary.

VII. DATA RETENTION PERIOD

1. Your data will be stored for the time necessary to complete the recruitment process of Digiteum. If you voluntarily agree to participate in future recruitments, your data will be stored for 3 years.
2. Your personal data, which your provided for download, will be processed for the duration of the agreement, until the statute of limitations for claims under the agreement.
3. Your personal data processed on the basis of a legitimate interest, will be processed for the period of existence of the controller's legitimate interest, no longer than until you file an objection.
4. Your data process on the basis of your consent, will be processed until you withdrawn this consent.

VIII. SOCIAL MEDIA

1. We use the "social plug-in", i.e. the Facebook, X or LinkedIn banners posted on the Website, which redirect to, respectively:

2. In connection with the Controller’s Facebook Profile, X Profile and LinkedIn Profile, as well as the posting of social plug-insif you are an EEA user, the co-administrator of the User data are also, respectively:
a)Meta Platforms Ireland Limited with its registered office in Dublin, Ireland, address: 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, D02X525, Ireland (hereinafter: "Facebook"),
b)LinkedIn Ireland Unlimited Company with registered office in Dublin (Ireland), address: Wilton Place, Dublin 2, Ireland (hereinafter: "LinkedIn"),
c)Twitter International Unlimited Company Inc. based in Dublin, Ireland, address: Fenian Street Dublin 2, D02 AX07 Ireland (hereinafter: "X")
and together with the Administrator as: "Co-Administrators").
3. The Co-Administrators include aggregate data analysis, the purpose of which is to display Facebook Profile, X Profile and LinkedIn Profile user activity statistics and advertising activities using the tools available there. IX. CHILDREN’S PERSONAL DATA

We do not knowingly collect any information from users under 16 years old. If we are made aware that we have such personal information, we will take reasonable steps to remove such information. If you think that your child provided any information on our website, contact us immediately by sending an email to [email protected] and we will remove such information from our records.

X. PERSONAL DATA RECIPIENTS

1. If you use the Digiteum website recipients of your personal data will be: server hosting providers, employees, associates of the Controller, and providers of legal services. If you provide appropriate consent for cookies, your data may also be transferred to third-party advertising service providers.
2. If you contact us of request to download our free materials, recipients of your personal data will be: server hosting providers, employees, associates of the Controller, a provider of mailing tools, and providers of legal services.
3. If you participate in the recruitment, your personal data may be provided to subcontractors of Digiteum such as suppliers of IT systems and IT services, email and server hosting providers, and, where reasonable, legal service providers.
4. If you interact with us through social network profiles recipients of your personal data will be: employees and associates of the Controller and social media providers.

XI. TRANSFER OF DATA OUTSIDE THE EUROPEAN ECONOMIC AREA (EEA)

1. The level of personal data protection outside the European Economic Area (EEA) differs from the one ensured by the European law. For the aforementioned reason, the Administrator shall transfer personal data outside the EEA only when this is necessary and assuring a relevant level of protection, in particular by means of:
a. cooperation with personal data processing entities in countries with respect to which a relevant decision of the European Commission was issued;
b. the application of standard contractual clauses issued by the European Commission;
c. the application of binding corporate rules approved by a competent supervision body;
2. The Administrator always informs about the intention of transferring personal data outside the EEA at the stage of collection thereof.
3. The Controller transfers personal data to third countries outside the European Economic Area (EEA), i.e.:
a. d. Google LLC with its registered office in California, USA – the provider of the following tools: Google Analytics and Google Search Control; a processor only of data allowing Website traffic analysis; Privacy standards information: https://policies.google.com/privacy?hl=en-US. e. Microsoft Corporation with its registered office in Redmond, Washington, USA – the provider of the Microsoft Clarity - analytics tool that helps us understand how users are interacting with our website through session replays and heatmaps. 4. All providers indicated in point 3 above adheres to the principles of the Europe-U.S. DPF (EU-U.S. DPF) agreement (Data Privacy Framework Program).
5. The Controller transfers personal data outside the European Economic Area to other entities only if expressly indicated in this Privacy Policy.

XII. INDIVIDUAL RIGHTS

Digiteum adheres to core data protection principles and is committed to transparently, lawfully and fairly process personal data, ensure its correctness, integrity and security and address the rights of data subjects with respect and responsibility. Compliant to the GDPR, Digiteum guarantees the fulfillment of these individual rights.

1. Right to be informed - we openly and transparently inform individuals how and why we collect and store their data, what data we collect, how we implement data protection and what rights individuals have in regards to the personal data stored with us.
2. Right of access - individuals can request to confirm that their personal data is stored with us and access their personal data to ensure the lawfulness of data collection and correctness of their data.
3. Right to rectification - Individuals can request to rectify their personal data if they find it incomplete or incorrect.
4. Right to erasure - Individuals can request to erase the personal data we store with us. We have procedures in place to fulfill such requests and reply to the individual’s query in the shortest time possible.
5. Right to restrict processing – Individuals can request to restrict the use of their personal data.
6. Right to withdraw consent - Individuals can withdraw their consent of processing their personal data. The withdrawal of consent shall not affect the lawfulness of processing carried out on the basis of consent prior to its withdrawal. We reserve the right to lift the restriction in case the processing of certain data is legally necessary, according to the GDPR. In this case, we priorly inform the individual of the case and explain why we have to lift the restriction.
7. Right to portability - Individuals can request to obtain the personal data they store with us and further reuse it for other purposes.
8. Right to object - Individuals can object to the usage of their personal data for marketing, scientific, research, or other legitimate purposes.
9. Rights related to automated decision making including profiling - We do not perform automated decision making including profiling.
10. You can also lodge a complaint with a competent supervisory authority - the President of the Data Protection Authority (PUODO) in Poland.

XIII. CHANGES TO PRIVACY POLICY

We review our Privacy Policy and other legal statements to make sure they are up to date and relevant to the current laws and regulations.
